FILM FESTIVAL INSIDER™ TERMS OF USE

Effective Date: May 28, 2026

This agreement (“Agreement”) governs your use and purchase of any digital or consulting products provided by Heather Brittain / Film Festival Insider™, including but not limited to: Insider Track™, Festival Fixr™, the Festival Strategy Intensive, private consulting calls, toolkits such as the Submission Tracker & Strategy System, and any other present or future products.
By purchasing, downloading, or engaging with any of these resources, you agree to the terms outlined herein. If you do not agree, you must not access or use any of our programs, content, or tools.
 

ACCESS DURATION

● Insider Track™: Lifetime access refers to the lifetime of the program and its availability on the hosting platform. While there is no planned expiration date, Heather Brittain / Film Festival Insider™ reserves the right to modify, update, replace, migrate, or discontinue the program, its content, or hosting platform as needed. In the event that Insider Track™ is permanently discontinued, enrolled members will receive at least twelve (12) months' advance notice and an opportunity to download any materials designated for download during that notice period.
● Festival Fixr™: Access is provided on a subscription basis (Monthly or Annual) and auto-renews until canceled by the user.
● Bundles: If Festival Fixr™ is bundled with Insider Track™, access to Festival Fixr™ is granted for one (1) year from the date of purchase.
● Submission Tracker Toolkit: Perpetual access to download and use for personal, non-commercial use.
● Private Strategy Sessions: 1-time access and use; recordings may be provided when applicable.

CONSULTING & STRATEGY SESSION POLICIES

These policies apply to all private consulting services, including the Festival Strategy Intensive (3-session package) and individual 1:1 Strategy Sessions.

● Session Expiration (Intensive): The Festival Strategy Intensive must be scheduled and completed within one (1) year of the original purchase date. Any unused sessions will expire after that period.
● Scheduling, Cancellations & Rescheduling:
● All bookings, cancellations, and rescheduling are managed via Calendly links provided to the client via email.
● Cancellations: Clients may cancel a session with a minimum of 24 hours' notice.
● Rescheduling: To ensure calendar availability, we require a minimum of 48 hours' notice to reschedule a session (unless prior arrangements have been made and approved in writing).
● Late Requests: Any cancellation or rescheduling request made with less than the required notice (24 hours for cancellation, 48 hours for rescheduling) may result in a forfeited session at Heather’s discretion.
● No-Shows: Failure to attend a scheduled session without prior notice will be considered a forfeited session and will not be eligible for rescheduling or refund.
● Transferability: Sessions are non-transferable and may only be used by the original purchaser unless otherwise approved in writing.
● Session Recordings: Session recordings, when provided, are for the personal use of the purchasing client only and may not be shared, distributed, reproduced, published, or resold.
● Consulting Scope: Strategic guidance, education, and feedback based on Heather Brittain's experience. Participation does not guarantee festival acceptance, awards, distribution, financing, or any specific outcome.

AI TOOL USAGE & THIRD-PARTY PLATFORMS

● Use: You may use Festival Fixr™ for personal, non-commercial strategic planning. Content is for individual use only and may not be resold or redistributed.
● Platform Access: Festival Fixr™ is delivered through OpenAI’s ChatGPT platform and requires an active ChatGPT Plus subscription (not included in your purchase).
● Limitations: We are not responsible for OpenAI's service availability, pricing, usage limits, technical changes, account restrictions, or future platform modifications that may affect access or functionality. No refunds will be issued due to third-party service interruptions or platform changes.
● AI Disclaimer: Strategic guidance provided by AI tools is for educational purposes. We are not liable for any inaccuracies, "hallucinations," or errors in AI-generated responses. 

REFUNDS & CANCELLATIONS

● Digital Products & Consulting: Due to the digital nature of these products and the reservation of calendar availability for consulting, all sales are final and non-refundable. Bundle purchases are also non-refundable and may not be partially refunded based on use or non-use of individual components.
● Subscriptions: For Festival Fixr™ subscriptions (Monthly or Annual), you may cancel at any time to prevent future billing. Cancellation will take effect at the end of the current billing cycle. No partial refunds are provided for unused time in a billing period.

CHARGEBACKS & PAYMENT DISPUTES

● By purchasing any product or service from Film Festival Insider™, you agree to contact us first at [email protected] to attempt resolution of any billing or service-related concerns before initiating a chargeback or payment dispute with your bank, credit card provider, or payment processor.
● Unauthorized chargebacks may result in immediate suspension or termination of access to purchased products, programs, communities, consulting services, course materials, and future purchases until the matter is resolved.

INTELLECTUAL PROPERTY & CONDUCT

● Ownership: All content, materials, scripts, templates, and AI-generated prompts remain the intellectual property of Heather Brittain and Film Festival Insider™.
● Restrictions: Unauthorized reproduction, resale, redistribution, reverse engineering, "jailbreaking," or scraping of AI data is strictly prohibited.

GENERAL DISCLAIMERS

We do not guarantee festival acceptance, distribution deals, or press coverage. Your results may vary based on execution, industry factors, and individual effort.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Heather Brittain and Film Festival Insider™ shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of any products, services, consulting, educational materials, AI tools, or related resources offered through Film Festival Insider™.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
