PLEASE READ THESE TERMS CAREFULLY. They form a binding agreement between you and Film Festival Insider, LLC and include automatic-renewal, refund, intellectual-property, disclaimer, and liability provisions. |
1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of the websites, checkout pages, member areas, courses, downloads, templates, trackers, artificial-intelligence tools, consulting services, online communities, emails, and other products or services offered by Film Festival Insider, LLC, doing business as Film Festival Insider (collectively, the "Services").
By visiting the website, creating an account, making a purchase, accessing a Service, or clicking to accept these Terms, you agree to these Terms and to any product-specific terms displayed at checkout. If you do not agree, do not use the Services. If product-specific checkout terms conflict with these Terms, the product-specific terms control for that purchase.
2. Eligibility and Authority
You must be at least 18 years old and legally able to enter a contract. If you use or purchase the Services for a company, production, or other organization, you represent that you have authority to bind that organization, and "you" includes both you and the organization.
3. Accounts and Account Security
You must provide accurate, current information and keep your login credentials confidential. Each purchase is for one purchaser or authorized user unless the applicable offer expressly states otherwise. You may not share an account, permit unauthorized access, or resell access. You are responsible for activity under your account and must promptly notify [email protected] of suspected unauthorized use.
Some Services are hosted by Kajabi or delivered through another third-party platform. Your use of those platforms is also subject to their terms and privacy practices.
4. Products, Services, and Access Periods
The features, bonuses, delivery method, prerequisites, and access period stated on the applicable sales or checkout page are part of your purchase. Unless the applicable offer states otherwise:
- Insider Track™. A purchase includes access for the commercial life of the Insider Track™ program, not for the purchaser’s lifetime. Film Festival Insider may update, reorganize, migrate, replace, or retire parts of the program. If Film Festival Insider permanently discontinues the entire program, it will provide commercially reasonable advance notice where feasible and, when practical, an opportunity to download any materials designated as downloadable.
- Freeway Fixr™. A standalone purchase includes access for the commercial life of the Freeway Fixr™ program on substantially the same basis described for Insider Track™. Freeway Fixr™ is also included as a bonus module with Insider Track™ while that inclusion is stated in the applicable offer.
- Festival Fixr™ standalone subscriptions. Monthly and annual plans provide access during the paid subscription term and automatically renew as described in Section 6 until canceled.
- Insider Bundle. The Insider Bundle includes the access stated at checkout, including one year of Festival Fixr™ access. The included one-year Festival Fixr™ period does not automatically renew. Continued Festival Fixr™ access after that year requires a new, affirmative purchase or opt-in.
- Submission Tracker and other downloads. A purchase grants a continuing license to use the delivered file for your own projects and internal professional work, subject to Sections 10 and 11. Film Festival Insider does not guarantee perpetual hosting or replacement downloads, so you should keep a backup of downloaded files.
- Consulting and strategy services. Sessions are delivered as described in the applicable offer. Unless a different period is stated at checkout, all sessions included in a package must be scheduled and completed within one year after purchase.
- Free resources and bonuses. Film Festival Insider may modify or discontinue free resources, bonuses, group access, or promotional features at any time unless a specific paid offer expressly guarantees them for a stated period.
5. Orders, Prices, Payments, and Taxes
Film Festival Insider, LLC is the seller of the Services and collects payment directly or through its payment processors. You authorize Film Festival Insider and its processors to charge the payment method you provide for the displayed price, applicable taxes, and any recurring amounts you affirmatively accept at checkout. Prices are shown in the currency displayed at checkout and may change for future purchases.
You are responsible for keeping payment information current. If a payment fails, Film Festival Insider or its processor may retry the charge, suspend access, or cancel the affected Service. You remain responsible for amounts lawfully due. Film Festival Insider may correct pricing or description errors before fulfilling an order and will offer a refund if it cannot honor a completed purchase because of such an error.
6. Automatic Renewal and Cancellation of Festival Fixr™
If you purchase a standalone monthly or annual Festival Fixr™ subscription, your subscription automatically renews at the end of each monthly or annual billing period, as applicable, and your payment method will be charged the then-current subscription price plus applicable taxes unless you cancel before the next renewal charge. The renewal frequency, price, and any trial or promotional terms will be disclosed at checkout. By completing the purchase, you expressly authorize recurring charges on that schedule.
Film Festival Insider will provide renewal reminders, price-change notices, and other automatic-renewal disclosures when and as required by applicable law. A price change applies no earlier than the next renewal after any legally required notice.
To cancel through the customer account when self-cancellation is available, log in, select your avatar, choose Settings, open Billing, select the menu next to the active subscription, and choose Cancel subscription. PayPal purchasers may be redirected to PayPal to cancel automatic payments. You may also request cancellation by emailing [email protected]. A cancellation request must be completed or received before the next renewal charge to prevent that charge. Keep the confirmation for your records.
Cancellation stops future renewals. Unless applicable law or the applicable offer requires otherwise, you will retain access through the end of the paid billing period and will not receive a prorated refund for unused time. If an account cancellation method is temporarily unavailable, contact [email protected] for assistance. The Insider Bundle’s included one-year Festival Fixr™ access is not a recurring subscription and expires without a renewal charge.
7. Consulting Scheduling, Cancellation, and Rescheduling
Consulting appointments are scheduled through the booking method Film Festival Insider provides, currently Calendly, and are subject to availability. Because preparation may begin before a session, the following rules apply unless the applicable offer states otherwise:
- Direct rescheduling. To move an existing appointment directly to another time, you must request the change at least 48 hours before the scheduled start time.
- Timely cancellation. You may cancel at least 24 hours before the scheduled start time without forfeiting the prepaid consultation fee. If the cancellation is made less than 48 hours but at least 24 hours before the session, the appointment will be canceled rather than directly moved; you may then book a new available time, subject to any package expiration date.
- Late cancellation. If you cancel less than 24 hours before the scheduled start time, the session and consultation fee may be forfeited at Film Festival Insider’s discretion.
- No-show. If you do not attend and have not timely canceled, the session and consultation fee are forfeited.
Consulting purchases and appointments are nontransferable without written permission. Any recording requires advance notice and the consent of all participants and is for the purchaser’s internal use only. Consulting is educational and strategic; it does not guarantee festival acceptance, awards, distribution, revenue, or any other outcome.
8. Refunds and Statutory Rights
Except as expressly stated in an offer or required by applicable law, sales of digital products, downloads, consulting, and completed subscription billing periods are final and nonrefundable. Canceling a subscription prevents future renewal charges but does not create a partial-period refund. Bundles are sold as a package and are not eligible for partial refunds merely because one component is unused.
Nothing in these Terms limits a refund, cancellation, cooling-off, conformity, or other consumer right that cannot lawfully be waived. If applicable law provides a withdrawal period for digital content or services and you request immediate access or performance, you expressly request delivery during that period and acknowledge that, to the extent permitted by law, your withdrawal right may end after digital content is supplied or the service is fully performed. Any required checkout consent or acknowledgment will apply.
9. Payment Disputes and Chargebacks
Please contact [email protected] first if you believe a charge is incorrect so Film Festival Insider can investigate promptly. This request does not limit any lawful dispute or chargeback right. Film Festival Insider may suspend access while a payment dispute is pending and may terminate access for fraudulent or bad-faith chargebacks, but will not penalize you merely for exercising a legitimate legal right.
10. Limited License and Permitted Professional Use
Subject to payment and compliance with these Terms, Film Festival Insider grants you a limited, nonexclusive, nontransferable, revocable license to access the purchased Services and use the materials for your own films, projects, business, and internal professional work. You may adapt worksheets, checklists, templates, and outputs for those purposes where the Service is designed to permit adaptation.
You may not share course access or files with others; reproduce or distribute substantial portions of the materials; publish, sublicense, sell, rent, or commercially exploit the materials; use them to provide a competing course, membership, template library, AI tool, or done-for-you service; remove proprietary notices; scrape or systematically extract content; reverse engineer or attempt to reveal private system instructions or proprietary prompts; bypass technical restrictions; or use the Services to train a competing model or product, except with Film Festival Insider’s written permission or where applicable law expressly permits the activity and does not allow it to be restricted.
11. Intellectual Property, Your Content, and Outputs
Film Festival Insider and its licensors own the Services and their original content, including course lessons, recordings, text, graphics, branding, frameworks, selection methods, worksheets, templates, databases, proprietary prompt structures, private system instructions, and the compilation and arrangement of those materials. No ownership transfers to you.
You retain any rights you have in materials you submit, upload, or paste into a Service ("User Content"). You represent that you have all rights and permissions necessary to use and submit User Content and that doing so does not violate law, confidentiality duties, privacy rights, publicity rights, or intellectual-property rights. You grant Film Festival Insider a limited license to host, process, and use User Content only as reasonably necessary to provide, secure, support, and improve the Services, subject to the Privacy Policy and applicable law.
As between you and Film Festival Insider, Film Festival Insider does not claim ownership of your specific AI outputs merely because you used Festival Fixr™. You may use those outputs for your own projects and internal professional work, subject to these Terms, applicable law, and the terms of the third-party AI provider. Outputs may include or reflect Film Festival Insider’s protected frameworks and may not be used to reconstruct, distribute, or commercialize those underlying materials. AI outputs may not be unique, and other users may receive similar output. Film Festival Insider does not promise that any output is eligible for copyright, trademark, or other exclusive protection.
12. Festival Fixr™, AI, and Third-Party Technology
Festival Fixr™ is an AI-assisted service delivered using technology provided by OpenAI and may use capabilities such as text analysis, research and web search, document generation, translation, image analysis, and image generation when available. Access may require a separate ChatGPT or OpenAI account and a compatible paid plan, as disclosed in the applicable offer. Charges paid to OpenAI or another third party are separate from amounts paid to Film Festival Insider.
AI services are probabilistic and may produce inaccurate, incomplete, fabricated, outdated, biased, or unsuitable information. You must independently review outputs and verify important facts against authoritative sources, especially festival eligibility, rules, categories, fees, submission deadlines, premiere requirements, rights clearances, media contacts, and contractual or legal requirements. Do not rely on the Services as legal, tax, financial, medical, accounting, or other regulated professional advice. You remain responsible for your submissions, decisions, creative work, clearances, and use of outputs.
Do not submit trade secrets, highly sensitive personal information, payment-card data, account credentials, private communications, unreleased third-party material, or other content you are not authorized to process. OpenAI and other technology providers may process, store, or retain information under their own terms, plan settings, and privacy policies. Film Festival Insider does not control their models, uptime, retention practices, safety systems, features, pricing, or policy changes and is not responsible for interruptions or changes outside its reasonable control.
A custom GPT builder generally cannot view individual user chats through the GPT itself, but that does not mean a conversation is invisible to OpenAI or exempt from OpenAI’s processing. Depending on the user’s account type and data-control settings, OpenAI may use or retain content as described in its policies. GPTs also may not use saved memory, custom instructions, or prior conversations, so each new conversation may begin without earlier context. Review OpenAI’s current terms and privacy disclosures before entering information.
13. Third-Party Services, Links, and No Affiliation
The Services may link to or interoperate with Kajabi, Calendly, Stripe, PayPal, Meta, Google, YouTube, Wistia, OpenAI, ChatGPT, FilmFreeway, social-media platforms, festival websites, and other third-party services. Film Festival Insider does not control and is not responsible for third-party content, availability, security, prices, policies, decisions, or performance. Your use of a third-party service is governed by its own terms.
Film Festival Insider, Festival Fixr™, Insider Track™, and Freeway Fixr™ are independent offerings. Film Festival Insider is not affiliated with, sponsored by, or endorsed by OpenAI, ChatGPT, FilmFreeway, Meta, Google, Kajabi, or any film festival unless an affiliation is expressly stated. Third-party names and marks belong to their respective owners.
14. Community and Social Features
Access to a Facebook group, online community, comments area, live session, or similar social feature is a limited privilege. You must communicate respectfully and may not harass, threaten, discriminate, impersonate, spam, solicit without permission, post unlawful or infringing material, disclose another person’s private information, or disrupt the community. Do not assume that information shared by other members is confidential or accurate.
Film Festival Insider may moderate or remove content and may suspend or remove a participant for serious or repeated violations. Removal from a community does not automatically cancel a separately purchased subscription or entitle the participant to a refund, except where required by law.
15. Acceptable Use
You may not use the Services to violate law; infringe or misappropriate rights; deceive or defraud; create or distribute malware; gain unauthorized access; interfere with security or operation; generate unlawful, abusive, defamatory, discriminatory, or exploitative content; submit personal information without a lawful basis; or assist another person in doing any prohibited act. Film Festival Insider may investigate suspected misuse and cooperate with lawful requests from authorities.
16. Suspension and Termination
Film Festival Insider may suspend or terminate access if you materially breach these Terms, fail to pay, create a security or legal risk, misuse intellectual property, harm other users, or use the Services unlawfully. When reasonable, Film Festival Insider will provide notice and an opportunity to cure a remediable breach. Immediate action may be taken for fraud, dangerous conduct, serious security risks, infringement, harassment, or other material harm.
You may stop using the Services at any time, but doing so does not itself cancel an automatically renewing subscription; follow Section 6. Upon termination, licenses granted to you end except for continuing rights expressly associated with a purchased download or output and provisions that by their nature should survive, including payment obligations, intellectual-property protections, disclaimers, liability limits, indemnity, dispute provisions, and general terms.
17. Educational Nature; No Guaranteed Results
The Services provide education, information, organizational tools, creative assistance, and strategic perspectives. Film festival selections and outcomes depend on many factors beyond Film Festival Insider’s control, including the film, programming needs, eligibility, timing, competition, budgets, relationships, rights, and festival decisions. Testimonials and examples illustrate individual experiences and do not guarantee that you will obtain the same or any result. You are solely responsible for how you apply the information.
18. Disclaimers of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." FILM FESTIVAL INSIDER DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS. FILM FESTIVAL INSIDER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, CURRENT, COMPATIBLE WITH EVERY DEVICE OR PLATFORM, OR FREE FROM HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILM FESTIVAL INSIDER, LLC AND ITS OWNER, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OPPORTUNITIES, DATA, GOODWILL, SUBMISSION FEES, FESTIVAL ACCEPTANCES, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO A SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FILM FESTIVAL INSIDER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT OR (B) US $100 IF THE SERVICE WAS FREE. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING ANY NONWAIVABLE CONSUMER RIGHT.
20. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Film Festival Insider, LLC and its owner, officers, employees, contractors, affiliates, and licensors from third-party claims, losses, liabilities, damages, judgments, and reasonable costs and attorneys’ fees arising from your User Content; your unlawful or unauthorized use of the Services or outputs; your infringement or violation of another person’s rights; or your material breach of these Terms. This provision does not require you to indemnify a party for its own unlawful conduct or negligence where such an obligation is prohibited by law.
21. Privacy, Cookies, and Electronic Communications
Film Festival Insider’s Privacy Policy and Cookie Policy explain how personal information and tracking technologies are handled and are incorporated into these Terms. By using the Services, you also consent to receive transactional electronic communications, including receipts, account notices, service updates, security notices, renewal or cancellation communications, and changes to legal terms. Marketing messages are governed by your consent choices and applicable law.

22. Changes to the Services and These Terms
Film Festival Insider may improve, update, replace, or discontinue features to reflect technology, law, security needs, business changes, or user needs. If a change materially reduces a paid Service during its paid term, Film Festival Insider will provide a reasonable remedy where required by law.
Film Festival Insider may update these Terms. The revised Terms will state a new effective date and will be posted on the website. Material changes will be communicated when required by law. Changes apply prospectively; continued use after the effective date constitutes acceptance where permitted. If you do not agree, stop using the Services and cancel any recurring subscription before its next renewal.
23. Governing Law and Venue
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute not subject to a different mandatory forum must be brought in the state or federal courts located in New Jersey, and each party consents to their jurisdiction. Nothing in this section deprives a consumer of protections or a forum that cannot lawfully be waived under the law of the consumer’s place of residence.
24. General Terms
These Terms, the policies incorporated by reference, and any applicable checkout terms are the entire agreement concerning the Services and replace prior discussions on the same subject. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. A waiver must be in writing and is not a continuing waiver. You may not assign these Terms without Film Festival Insider’s written consent; Film Festival Insider may assign them in connection with a merger, acquisition, financing, sale of assets, reorganization, or transfer of the Services, subject to applicable law.
Film Festival Insider is not liable for delay or failure caused by events beyond its reasonable control, including outages, platform failures, disasters, labor disputes, government action, war, terrorism, epidemics, utility failures, or failures of Internet or payment infrastructure. Section headings are for convenience only. The words "including" and "such as" are illustrative and not limiting.
